Confirmed - Islamic State has Destroyed the Ancient Temple of Bel in Syria's Palmyra

Just one day after UN training and research agency UNITAR had confirmed via satellite images that Palmyra's Baalshamin Temple was destroyed by Islamic State militants, ARCA has received word from multiple direct and indirect sources that The Temple of Bel has also been targeted.  The temple is aligned along the eastern end of the Great Colonnade at Palmyra and its epigraphic remains attest to the temple's dedication in 32 C.E.  After that, it underwent changes through the course of both the first and second centuries. Since the spread of Islam in the 7th century the Temple of Bel has been used as a mosque though the 1920s.

The Temple of Bel's cella are unique.  Two inner sanctuaries, the north and south adytons ((a restricted area within the cella of a Greek or Roman temple) are dedicated as the shrines of Bel and other local deities. Both the North and the South chambers had monolithic ceilings. The Northern chamber’s ceiling highlighted seven planets surrounded by twelve zodiac carvings as well as a camel procession, a veiled women, and what is believed to be Makkabel, the god of fertility.  While many believed the temple's repurposing as a mosque would have offered it protection, this imagery may have been the target for destruction under Daesh idiology.

The Islamic State took control of the historic site of Ancient Palmyra on the May 21, 2015.  The extent of the damage to the Roman-era structure is still being investigated.

Due to the number of conflicting reports, ARCA has been continually aggregating reports on the status of the Temple of Bel as more conclusive information came in and could be corroborated.

Update September 01, 2015 07:30 GMT+1 At 7:30 this morning, ARCA posted word that the UN Training and Research Agency (UNITAR) had confirmed that satellite images received have confirmed that the Temple of Bel, in the ancient city of Palmyra in northern Syria has been destroyed. Tom Holland, and London-based writer and historian gave this sad, but fitting eulogy, which we have included in the satellite photo caption below.

UN Training and Research Agency (UNITAR) posted news of their satellite and image analysis shortly after midnight.  Their written statement reads "We can confirm destruction of the main building of the Temple of Bel as well as a row of columns in its immediate vicinity."

Einar Bjorgo, manager of UNITAR’s Operational Satellite Applications Programme - (UNOSAT) said a satellite image taken Monday "unfortunately shows the destruction of the temple's main building as well as a row of columns in its immediate vicinity."

Update August 31, 2015 15:10 GMT+1 Speaking to the Associated Press via Skype today, an Islamic State operative has said that the temple (of Bel) had been destroyed, without elaborating. The individual spoke on condition of anonymity because members of the group are not allowed to speak to journalists.

Update August 31, 2015 15:10 GMT+1 Director-General of Syria’s Antiquities and Museums (DGAM) issues a formal statement on their website which reads, in part, "DGAM could not verify this news with confident resources, so the act is not sure nor the size of destruction, hoping it is not true."

Update August 31, 2015 14:30 GMT+1 New York Times article, quoting Syria's Director-General of Antiquities and Museums (DGAM), Maumoon Abdul-Karim, seems to indicate the two inner sanctuaries, the north and south adytons, were the target in this attack on Palmyra's immovable heritage.

Update August 31, 2015 14:15 GMT+1 Reached in Damascus, Maumoon Abdul-Karim, the Director-General of Syria’s Antiquities and Museums (DGAM) has told the Guardian “The temple structure is on a raised terrace that can be seen from afar, and our information is that the temple is still there,” 

Update August 31, 2015 13:36 GMT+1 Speaking to the Associated Press via Skype today, an Islamic State operative has said that the temple (of Bel) had been destroyed, without elaborating. The individual spoke on condition of anonymity because members of the group are not allowed to speak to journalists.

Update August 31, 2015 09:38 GMT+1 A report by Business Insider stated that Mohamed Hassan al-Homsi, an activist from Tadmor who uses a pseudonym, had indicated that the group has used explosives to destroy the inner part of the temple.  Al-Homsi is reported to have said

"They laid the explosives today, using booby-trapped boxes and barrels that were already prepared by IS”

The report also stated that Maumoon Abdul-Karim, the Director-General of Syria’s Antiquities and Museums (DGAM) was reached by phone in Damascus, but that he could not yet confirm the destruction.  Professor Abdul-Karim said

"Rumours about these ruins are always coming out so we have to be careful about news like this."

Update August 31, 2015 03:38 GMT+1 Report via the Washington Post states that a contact in Hom’s outside Islamic State territory, using the pseudonym, Khaled al-Homsi, collaborates reports that the Temple of Bel was blown up Sunday afternoon.

Update August 31, 2015 00:36 GMT+1 An Al Jazeera reporter in the Syrian city of Homs was told that ISIL on Sunday detonated more than 30 tonnes of explosives.  Note: 30 tones would be a significant amount of explosives. If this is correct, the size and sound of the explosion would likely have resembled something similar to what is seen in this video. 

Update August 30, 2015 23:15 GMT+1 AP and CBS and news reported that a resident, possibly from Tadmor and going by the name "Nasser al-Thaer" reported that a substantial blast went off at 1:45 pm Sunday afternoon. This contact also reported "it is total destruction" and that "the bricks and the columns are on the ground."   This witness may be the same person who spoke with AP reporters who confirmed the destruction of Palmyra's Baalshamin Temple Destruction and who previously reported to Syria Deeply on July 21, 2015 that bombs had been planted in the historic temples of Bel and Baal Shamin. 

Update August 30, 2015 22:10 GMT +1 The Syrian Observatory for Human Rights has also received word that the temple was targeted but has no further information on the extent of the damage.

UN Training and Research Agency UNITAR Visually Confirms Palmyra's Baalshamin Temple Destruction

UN training and research agency UNITAR has confirmed satellite images taken on August 25 2015 visually confirms the destruction of Palmyra's Baalshamin Temple by Islamic State militants. 

Comparing images of the ancient city of Palmyra taken on May 22, 2015 by Pléiades Earth-observation system managed by Airbus Defence and Space with a later image taken on or around August 25, 2015 UNITAR has issued a statement saying:  

"We confirm the destruction of the main building, while surrounding columns seem to be less affected."

The destruction of the temple was reported to have happened last Sunday, August 23, 2015 shortly after 4:00 pm shortly after the Islamic State published photos indicating they had beheaded Khaled Mohamad al-Asaad, the retired head of antiquities for the ancient city of Palmyra, a UNESCO World Heritage Site. 

Earlier this week the Islamic State published images showing various containers, containers, presumably containing explosives, placed around and inside the temple as well as an image of what appeared to be a large explosion at the time of the temple’s detonation. 

Comparing site map images of Palmyra by Ross Burns, an author of two works on the archaeology and history of Syria, with the newly released Pléiades image reviewed by UNITAR, one can see that at the time the images were taken the Temple of Nabû had apparently not been subject to intentional destruction.   Nabû’s temple is located to left of the colonnaded street adjacent to the monumental arch of Septimius Severus. Nabû is believed to have been a Mesopotamian god of wisdom and oracles.  The trapezoid-shapped temple dates from the last quarter of the 1st century CE through to the 3rd century.

Further Information Dating Destruction of the Temple of Baal Shamin

News sources reported earlier this week via Maamoun Abdul Karim, of Syria's DGAM that the Islamic State militants recently destroyed the Temple of Baal Shamin (Arabic - تدمر – معبد بعلشمين ) . located in the 2,000-year-old Roman-era city of Palmyra and to the north of the city's acropolis.

Further news from the AP today reported that the bombing likely took place Sunday, August 23, 2015 shortly after 4pm. 


A witness, using the name Nasser al-Thaer, spoke with journalists affiliated with the AP saying
I went to see it, not from very close because IS (militants) were there and because I was worried for myself and afraid they will ask me what are you doing here. So I saw it from a distance. 
A 25-year-old activist, also going by the name Nasser al-Thaer, had previous spoken with the organization Syria Deeply reporting on conditions inside Tadmur,  the modern city situated about 500 metres (1⁄3 mi) northeast of the ancient historical site of Palmyra.

An Islamic State operative, who spoke on the condition of anonymity with journalists from the AP, confirmed that the organisation would be issuing its own statement soon.

The United Nations Scien­tific and Cultural body (UNESCOn) has stated that the temple's destruction was “an immense loss for the Syrian people and for humanity”.  The head of UNESCO, Irina Bokova has also called the heinous act a “war crime”.

At the time of this reporting, five photos of the destruction of the temple have recently been released by by Islamic militants and distributed on social media.  The images show explosives set at the historic site, a mushroom cloud image freeze-framing the explosion and the resulting rubble.

Out of respect for the people of Syria, the residents of Tadmur and those that have lost their lives in the protection of Syria's cultural heritage, ARCA will not be publishing ISIL, ISIS, Islamic State, Daesh, Daish heritage "snuff" videos of the temple's destruction.

Temple of Baal Shamin, Palmyra Destroyed

Maamoun Abdul Karim, of Syria's DGAM says Islamic State militants have destroyed the Temple of Baal Shamin (Arabic - تدمر – معبد بعلشمين ) located in the 2,000-year-old Roman-era city of Palmyra and to the north of the city's acropolis. The temple was located 500 metres from Palmyra’s amphitheatre, where Islamic State militants killed 20 Syrian soldiers shortly after overtaking the historical site and the modern city of Tadmor in May 2015.

Portions of the temple complex dated to 17 CE though it went through numerous phases of construction in subsequent centuries. Based on inscriptions, the inner temple, or cella was thought to have been dated to 131 CE, immediately after the Roman Emperor Hadrian’s visit to the city one year earlier.

Activists reporting from the occupied zone have said that militants used explosives to blow up the Baalshamin Temple. The blast is also believed to have been powerful enough to have also damaged some of the Roman columns surrounding the temple site.  

The Syrian Observatory for Human Rights, which relies on a network of sources on the ground, said explosives were laid at the site of the Roman ruins at the town, in late June 2015.   The exact date of the temple's destruction remains unclear. 

The Temple of Baal Shamin was one of two major temples located at with the confines of the Palmyra archaeological site (along with other lessor temples). No news yet on the status of the Temple of Bel, located at the far end of Palmyra's Grand Colonnade in the southeastern end of the city.  This second temple is thought to have been converted in the 5th century CE into a church and in the 12th century into a citadel by the arabs.

The present conflict in Syria and northern Iraq has brought the issue of antiquities to the attention of the international media. This is due, first, to the scale of the recent looting revealed by remote sensing, second, to the possibility that archaeological objects were being used to fund the conflict, and third, to the deliberate destruction of key monuments and museum objects in what can only be described as acts of "cultural barbarism". At the same time there are more pressing concerns about the plight of refugees from the conflict zones, and the deliberate targeting of religious minorities. 
Looting is not a new phenomenon to Syria. And there have been instances in recent years of objects linked to that region turning up on the antiquities market. In April 2009 six Roman limestone busts surfaced on the London market at Bonhams (April 29, 2009, lots 48-53). ...

US Legislature calling for the protection and preservation of international cultural property at risk due to political instability, armed conflict, or natural or other disasters, and for other purposes.

Earlier in March 2015, Representative Eliot L Engel, [D-NY-16] introduced a Bill in the 114th Congress, First Session, -- via the House - Armed Services; Foreign Affairs; Judiciary; Ways and Means Committee and also referred to the Committee on Foreign Affairs -- calling for the protection and preservation of international cultural property at risk due to political instability, armed conflict, or natural or other disasters, and for other purposes [A copy of that bill has been included in its entirety below].

In addition, four members of the US House Foreign Affairs Committee wrote a letter to Adam Szubin, Director of Treasury’s Office of Foreign Assets Control (OFAC)urging the U.S. to block import of looted Syrian antiquities:
We write to urge that the Department of Treasury’s Office of Foreign Assets Control act quickly to promulgate regulations imposing sanctions on importers of cultural property unlawfully removed from Syria,” the letter, issued on Monday, said. “Such regulations would implement a recently adopted United Nations Security Council Resolution and would mirror regulations already established for Iraq.

A BILL
To protect and preserve international cultural property at risk due to political instability, armed conflict, or natural or other disasters, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.
This Act may be cited as the “Protect and Preserve International Cultural Property Act”.

SEC. 2. Definition.
In this Act:

(1) APPROPRIATE CONGRESSIONAL COMMITTEES.—The term “appropriate congressional committees” means the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate.

(2) CULTURAL PROPERTY.—The term “cultural property” includes property covered under—
(A) the Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict, concluded at The Hague on May 14, 1954 (Treaty Doc. 106–1(A));

(B) Article 1 of the Convention Concerning the Protection of the World’s Cultural and Natural Heritage, adopted by UNESCO on November 23, 1972 (commonly referred to as the “1972 Convention”); or

(C) Article 1 of the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export, and Transfer of Ownership of Cultural Property, adopted by UNESCO on November 14, 1970 (commonly referred to as the “1970 UNESCO Convention”).

SEC. 3. Findings and statement of policy.

(a) Findings.—Congress finds the following:
(1) Over the years, international cultural property has been looted, trafficked, lost, damaged, or destroyed due to political instability, armed conflict, natural disasters, and other threats.

(2) During China’s Cultural Revolution, many antiques were destroyed, including a large portion of old Beijing, and Chinese authorities are now attempting to rebuild portions of China’s lost architectural heritage.

(3) In 1975, the Khmer Rouge, after seizing power in Cambodia, systematically destroyed mosques and nearly every Catholic church in the country, along with many Buddhist temples, statues, and Buddhist literature.

(4) In 2001, the Taliban destroyed the Bamiyan Buddhas, ancient statues carved into a cliffside in central Afghanistan, leading to worldwide condemnation.

(5) After the fall of Saddam Hussein, thieves looted the Iraq Museum in Baghdad, resulting in the loss of approximately 15,000 items, including ancient amulets, sculptures, ivories, and cylinder seals. Many of these items remain unrecovered.

(6) The 2004 Indian Ocean earthquake and tsunami not only affected 11 countries, causing massive loss of life, but also damaged or destroyed libraries, archives, and World Heritage Sites such as the Mahabalipuram in India, the Sun Temple of Koranak on the Bay of Bengal, and the Old Town of Galle and its fortifications in Sri Lanka.

(7) In Haiti, the 2010 earthquake destroyed art, artifacts, and archives, and partially destroyed the 17th century Haitian city of Jacmel.

(8) In Mali, the Al-Qaeda affiliated terrorist group Ansar Dine destroyed tombs and shrines in the ancient city of Timbuktu—a major center for trade, scholarship, and Islam in the 15th and 16th centuries—and threatened collections of ancient manuscripts.

(9) In Egypt, recent political instability has led to the ransacking of museums, resulting in the destruction of countless ancient artifacts that will forever leave gaps in humanity’s record of the ancient Egyptian civilization.

(10) In Syria, the ongoing civil war has resulted in the shelling of medieval cities, damage to five World Heritage Sites, and the looting of museums containing artifacts that date back more than six millennia and include some of the earliest examples of writing.

(11) In Iraq and Syria, the militant group ISIL has destroyed numerous cultural sites and artifacts, such as the Tomb of Jonah in July 2014, in an effort to eradicate ethnic and religious minorities from contested territories. Concurrently, cultural antiquities that escape demolition are looted and trafficked to help fund ISIL’s militant operations.

(12) On February 12, 2015, the United Nations Security Council unanimously adopted resolution 2199 (2015), which “[r]eaffirms its decision in paragraph 7 of resolution 1483 (2003) and decides that all Member States shall take appropriate steps to prevent the trade in Iraqi and Syrian cultural property and other items of archaeological, historical, cultural, rare scientific, and religious importance illegally removed from Iraq since 6 August 1990 and from Syria since 15 March 2011, including by prohibiting cross-border trade in such items, thereby allowing for their eventual safe return to the Iraqi and Syrian people.”.

(13) United Nations Security Council resolution 2199 (2015) also warns that ISIL and other extremist groups are trafficking cultural heritage items from Iraq and Syria to fund their recruitment efforts and carry out terrorist attacks.

(14) Cultural property represents an irreparable loss of humanity’s common cultural heritage and is therefore a loss for all Americans.

(15) Protecting international cultural property is a vital part of United States cultural diplomacy, showing the respect of the United States for other cultures and the common heritage of humanity.

(16) The United States Armed Forces have played important roles in preserving and protecting cultural property. In 1943, President Franklin D. Roosevelt established a commission to advise the United States military on the protection of cultural property. The commission formed teams of individuals known as the “Monuments Men” who are credited with securing, cataloguing, and returning hundreds of thousands of works of art stolen by the Nazis during World War II.

(17) The Department of State, in response to the Convention on Cultural Property Implementation Act, noted that “the legislation is important to our foreign relations, including our international cultural relations. The expanding worldwide trade in objects of archaeological and ethnological interest has led to wholesale depredations in some countries, resulting in the mutilation of ceremonial centers and archaeological complexes of ancient civilizations and the removal of stone sculptures and reliefs.”. The Department further noted that “[t]he United States considers that on grounds of principle, good foreign relations, and concern for the preservation of the cultural heritage of mankind, it should render assistance in these situations.”.

(18) The U.S. Committee of the Blue Shield was founded in 2006 to support the implementation of the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict and to coordinate with the United States military, other branches of the United States Government, and other cultural heritage nongovernmental organizations in preserving international cultural property threatened by political instability, armed conflict, or natural or other disasters.

(b) Statement of policy.—It shall be the policy of the United States to—
(1) protect and preserve international cultural property at risk of looting, trafficking, and destruction due to political instability, armed conflict, or natural or other disasters;

(2) protect international cultural property pursuant to its obligations under international treaties to which the United States is a party;

(3) prevent, in accordance with existing laws, importation of cultural property pillaged, looted, stolen, or trafficked at all times, including during political instability, armed conflict, or natural or other disasters; and

(4) ensure that existing laws and regulations, including import restrictions imposed through the Office of Foreign Asset Control (OFAC) of the Department of the Treasury, are fully implemented to prevent trafficking in stolen or looted cultural property.

SEC. 4. United States Coordinator for International Cultural Property Protection.
The Secretary of State shall designate a Department of State employee at the Assistant Secretary level or above to serve concurrently as the United States Coordinator for International Cultural Property Protection. The Coordinator shall—

(1) coordinate and promote efforts to protect international cultural property, especially activities that involve multiple Federal agencies;

(2) act as Chair of the Coordinating Committee on International Cultural Property Protection established under section 5;

(3) resolve interagency differences;

(4) develop strategies to reduce illegal trade and trafficking in international cultural property in the United States and abroad, including by reducing consumer demand for such trade;

(5) support activities to assist countries that are the principle sources of trafficked cultural property to protect cultural heritage sites and to prevent cultural property looting and theft;

(6) work with and consult domestic and international actors such as foreign governments, intergovernmental organizations, nongovernmental organizations, museums, educational institutions, and research institutions to protect international cultural property; and

(7) submit to the appropriate congressional committees the annual report required under section 6.

SEC. 5. Coordinating Committee on International Cultural Property Protection.

(a) Establishment.—There is established a Coordinating Committee on International Cultural Property Protection (in this section referred to as the “Committee”).

(b) Functions.—The full Committee shall meet not less often than annually to coordinate and inform Federal efforts to protect international cultural property and to facilitate the work of the United States Coordinator for International Cultural Property Protection designated under section 4.

(c) Membership.—The Committee shall be composed of the United States Coordinator for International Cultural Property Protection, who shall act as Chair, and representatives of the following:
(1) The Department of State.

(2) The Department of Defense.

(3) The Department of Homeland Security, including U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection.

(4) The Department of the Interior.

(5) The Department of Justice, including the Federal Bureau of Investigation.

(6) The United States Agency for International Development.

(7) The Smithsonian Institution.

(8) The U.S. Committee of the Blue Shield.

(9) Such other entities as the Chair determines appropriate.

(d) Subcommittees.—The Committee may include such subcommittees and taskforces as the Chair determines appropriate. Such subcommittees or taskforces may be comprised of a subset of the Committee members or of such other members as the Chair determines appropriate. At the discretion of the Chair, the provisions of the Federal Advisory Committee Act (5 U.S.C. App.) and section 552b of title 5 of the United States Code (relating to open meetings) shall not apply to activities of such subcommittees or taskforces.

(e) Consultation.—The Committee shall consult with governmental and nongovernmental organizations, including museums, educational institutions, and research institutions on efforts to promote and protect international cultural property.

SEC. 6. Reports on activities to protect international cultural property.
The Secretary of State, acting through the United States Coordinator for International Cultural Property Protection, and in consultation with the Administrator of the United States Agency for International Development, the Secretary of Defense, the Attorney General, and the Secretary of Homeland Security, as appropriate, shall annually submit to the appropriate congressional committees a report that includes information on activities of—

(1) the United States Coordinator and the Coordinating Committee on International Cultural Property Protection to protect international cultural property;

(2) the Department of State to protect international cultural property, including activities undertaken pursuant to the Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict, and other statutes, international agreements, and policies, including—
(A) procedures the Department has instituted to protect international cultural property at risk of destruction due to political instability, armed conflict, or natural or other disasters; and

(B) actions the Department has taken to protect international cultural property in conflicts to which the United States is a party;

(3) the United States Agency for International Development (USAID) to protect international cultural property, including activities and coordination with other Federal agencies, international organizations, and nongovernmental organizations regarding the protection of international cultural property at risk due to political unrest, armed conflict, natural or other disasters, and USAID development programs;

(4) the Department of Defense to protect international cultural property, including activities undertaken pursuant to the Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict and other cultural property protection statutes and international agreements, including—
(A) directives, policies, and regulations the Department has instituted to protect international cultural property at risk of destruction due to political instability, armed conflict, or natural or other disasters; and

(B) actions the Department has taken to avoid damage to cultural property through construction activities abroad; and

(5) the Department of Homeland Security and the Department of Justice, including the Federal Bureau of Investigation, to protect both international cultural property abroad and international cultural property located in, or attempted to be imported into, the United States, including activities undertaken pursuant to statutes and international agreements, including—
(A) statutes and regulations the Department has employed in criminal, civil, and civil forfeiture actions to prevent and interdict trafficking in stolen and smuggled cultural property, including investigations into transnational organized crime and smuggling networks; and

(B) actions the Department has taken in order to ensure the consistent and effective application of law in cases relating to both international cultural property abroad and international cultural property located in, or attempted to be imported into, the United States.

SEC. 7. Authorization for Federal agencies to engage in international cultural property protection activities with the Smithsonian Institution.
Notwithstanding any other provision of law, any agency that is involved in international cultural property protection activities is authorized to enter into agreements or memoranda of understanding with the Smithsonian Institution to temporarily engage personnel from the Smithsonian Institution for the purposes of furthering such international cultural property protection activities.

SEC. 8. Emergency protection for Syrian cultural property.

(a) Presidential determination.—Notwithstanding subsection (b) of section 304 of the Convention on Cultural Property Implementation Act (19 U.S.C. 2603) (relating to a Presidential determination that an emergency condition applies with respect to any archaeological or ethnological material of any State Party to the Convention), the President shall apply the import restrictions referred to in such section 304 with respect to any archaeological or ethnological material of Syria, except that subsection (c) of such section 304 shall not apply. Such import restrictions shall take effect not later than 120 days after the date of the enactment of this Act.

(b) Definitions.—In this section—
(1) the term “archaeological or ethnological material of Syria” means cultural property of Syria and other items of archaeological, historical, cultural, rare scientific, or religious importance unlawfully removed from Syria on or after March 15, 2011; and

(2) the term “State Party” has the meaning given such term in section 302 of the Convention on Cultural Property Implementation Act (19 U.S.C. 2601).

Antiquities traffickers continue to make headlines in multiple countries in 2015.  In this three part series, ARCA explores current art trafficking cases to underscore that the ownership and commodification of the past continues. 

Part II - The Dodgy Dealer and Conflict Antiquities - Buyer Beware

Tuesday, investigative reporter Simon Cox's "File on Four" program on BBC Radio 4 featured a radio segment titled "Islamic State: Looting for Terror".  A synopsis of the episode on antiquities looting in its written form, and with accompanying video excerpts, is available on the BBC News Magazine website here. The program illustrated, with present-day examples, how illicit antiquities trafficking  sells cultural heritage objects that are often poorly protected, difficult to identify, and easy to transport across international boundaries, especially during conflicts due to the flow of refugees.  The radio broadcast featured interviews with both London and Middle East experts, one of whom, Dr. David Gill of Looting Matters, validated that conflict antiquities do make their way into the UK art market and from there on to collectors.

But rather than recount the program's content, which on its own deftly underscores that the illicit market in conflict antiquities is alive and producing devastating results for source countries like Syria and Iraq, this article focuses on the buyer's side of the market and explores the attitudes of complacent dealers who too often treat the furor over smuggled antiquities as a bothersome nuisance that interferes with their ability to make  living.

In the world of crime, morals follow money.

Not wanting to enter into the ongoing oppositional debate with antiquities dealers or collectors, I decided to spend some time listening to the folks involved in the trade as they talked with one another about collecting and the collecting market. Too often heritage protection advocates get pigeon-holed as the noisy minority of academic archaeologists who oppose acquisition of unprovenanced ancient art.  My goal was to be anything but noisy, and to merely observe.

Publicly, pro-collector blogs frequently argue that nationalistic retention laws for antiquities neither preserve sites nor objects, nor do they benefit the larger interests of civilization and mankind.  But what do collectors and dealers have to say to one another about their own responsibility to preserve site?  And how do they truly feel when it comes to merchandise that enters the art market as a result of the illicit antiquities trade?

To get a better understanding I started by reading through the websites of the International Association of Dealers in Ancient Art (IADAA) and the Association of Dealers & Collectors of Ancient & Ethnographic Arts.  Both the IADAA and the ADCAEA's mission statements advocate for the responsible and legal trading and collecting of antiquities. 

  • promote awareness and understanding of ancient and ethnographic art collecting through open communication with members and the public.
  • support the preservation and protection of cultural objects around the globe through responsible and legal trading and collecting.
  • educate and inform members on policies and laws that affects the international movement of cultural property.
  • advocate and support the establishment of clear, transparent and fair laws governing acquisition, ownership and commercial disposal of artifacts.
  • promote a Code of Conduct that underscores the professionalism of our members through responsible and ethical practice.
  • advocate the establishment of a comprehensive digital database register within the USA to secure appropriate title to art and artifacts for museums, dealers and collectors and restore legitimacy and value to objects registered.
Good objectives to strive for even if I found their December 29, 2014 blog post a lot more threatened and defensive as this opening paragraph shows.
As a result, several American museums have been coerced into giving objects to foreign governments that have claimed them as their rightful property purely for political purposes.  American collectors and art dealers as well have been forced to repeatedly defend themselves against all manner of claims by foreign governments for countless pieces of art work that have been dispersed around the globe.  Increasingly, Americans have had to defend themselves in costly litigation against foreign governments who use American lawyers, US Customs, and Homeland Security, and the Press to pursue spurious claims against US citizens.  At the same time these foreign nations do very little to protect their archaeological resources or stem the tide of illicit excavation on their own soil.  The old paradigm of “antiquities collecting equals destruction of cultural heritage and therefore must be abolished” is naive at best and slanderous at worst.
To understand the reason for this defensiveness among dealers and collectors I thought it worthwhile to listen to them chat amongst themselves in non-official capacities, perhaps learning about what drew them individually to the field rather than assume I understood how dealers and collectors truly feel by looking at their safety-in-numbers mission statements.  Wording for large public statements often makes for adversarial lines in the heritage protection sand.   

I joined several collecting groups in hopes of better understanding "their side of the story".  Clearly heritage protection professionals and dealers and collectors should be able to solve their differences if if there is goodwill on all sides.

But is there?

One of the first comments I came across discussed Muslim militants threatening ancient sites in Iraq and Syria.  One dealer staunchly stated over email...
The lesson is clear here. The best overall strategy to preserve mankind's shared global heritage is NOT to keep it all concentrated in the original source countries, but rather to widely distribute it around the world.
"Widely distributed" having the added benefit of also generating revenue for dealers and a source of joy for the buyer.  Each doing their part to salvage history away from the ongoing conflict. But was their viewpoint a noble one?   The rest of the email is listed below for the reader to decide...

Hopefully they will loot and sell them first rather than destroying them! But then we dealers would probably be charged with funding terrorism by our wonderful politically correct governments.
Further in the same conversational thread another mid-level dealer replied...
I have bought many ! objects of ' fetishes and gods' from Moslem Runners who have no problems selling these pieces; nor do I have in buying then.
apparently referring to the secular nature of some Muslim looters and smugglers who don't necessarily subscribe to the religious ideology of Isis, Isil or Da'ish when selecting antiquities for trafficking.

Perhaps in jest, or perhaps by way of introduction, another dealer wrote a How-to email on how to smuggle antiquities from Egypt saying...
 Hello to you all.

I would like to share with you my thought regarding how a piece you end up buying in auction like Bonhams or Christie's is actually looted.

- A poor farmer in Egypt finds it while plowing his land.

- He is scared to report it considering the hell he will go through, confiscating his land , ending up in jail , family dying from hunger etc... so he sells it to the local dealer in the village

- Local dealer sells it to the middle man in Cairo

- Middle man sells it to the big boss in Cairo.

- Big boss smuggles it to an Arabian gulf country, e.g. Qatar, Dubai (UAE), Bahrain

- Piece then shipped to a stupid European country , e.g. Portugal.  sorry, stupid meaning = level of customs awareness

- Then an invoice is made from a dealer in another European country e.g. Belgium, to this Portuguese dealer for the piece, of course nobody checks, it's an EU transaction, no tax , no customs.

- Based on the Belgian invoice, the Portuguese dealer make an export license to U.S.A from ministry of culture, piece origin from Belgium, this totally cancels the fact that the piece came from the Arabian gulf.

- Item received in the U.S, no trouble, legal ,

- Item sold in auction  + old European collection, legally entered to U.S , customs paid.
Do ethics even enter into collector-dealer purchase discussions?  For some yes, but too frequently no.

In listening to collectors' observations I found that not all were black sheep.  While some over-sharing group members aired their profession's dirty laundry, others called for restraint in purchasing and recommended that dealers and collectors stick to objects with verifiable collecting histories.  Some dealers and collectors reached out to one another to help determine if a piece had value, was original or knew someone in the business who might have information on the object's past in the antiquities marketplace.   At face value their motive appears to be less driven by ethics and more by the desire to preserve value for money on object purchases and investments. Objects with sketchy pasts are still money spent in purchase but make for risky investments.

Some dealers and collectors outed dealers known to have sold fakes or to have had problems with previous law violations like Mousa Khouli who also goes by the name Morris.  Dealers reminded new members of the group that Khouli had sold through  Windsor Antiquities as well as Palmyra Heritage, and through eBay as palmyraheritagemorriskhouligallery.

Several group members pointed out pieces that they found problematic on Khouli current auction events such as this listing for an Ancient Roman Egyptian Painted stucco Mummy Mask c.1st century AD and this Palmyran Limestone Head Ca. 3rd-5th century A.D.  I myself notice he trades in Syrian coins, ancient glass and mummy cartonnage.

Khouli is not new to the art and antiquities profession.  He moved to New York City with his family from Syria in 1992 and opened a gallery specializing in the ancient world in New York City in 1995. His father had a gallery in Damascus for 35 Years, and he learned the business from his grandfather who also worked in the art and antiquities collecting field.  When prosecuted in 2012 he was already a seasoned and substantial seller in the New York market.

But Khouli eventually pled guilty to smuggling ancient Egyptian treasure and to making a false statement to law enforcement authorities.  He was sentenced to six months home confinement, one year probation, and 200 hours of community service, along with a criminal monetary assessment of $200.  Today he continues in the business he knows, the buying and selling of history. 

The response by his peers for his misdeeds?....   
Everyone's at it, he just happened to get caught.
Interestingly, like with the How To Smuggle recipe the earlier dealer described, Khouli's smuggled objects were imported via Dubai.

Maybe the one thing heritage workers and the collection community should agree on is that the "white" (clean) art collecting trade is dirtied when black market antiquities are circulated via suspect dealers and purchasers. Singular source countries, acting alone, cannot tackle all of the triangulations between looter, smuggler, dealer and buyer without the active support of neighboring countries, law enforcement and the art collecting community themselves.

Yesterday's Cambodia, is today's Syria and tomorrow's Ukraine, as the grey market of antiquities shifts from one vulnerable nation or one conflict zone to another.

Ar-Raqqah Museum in Syria continues to Suffer

Yesterday a report came in from the Syrian Arabic Republic - Ministry of Culture's Directorate General of Antiquities and Museums (DGAM) that a bomb dropped in Raqqa (ar-Raqqa, ar-Raqqah, Raqqa, Rakka), Syria near Arafat Square has done structural damage to the main facades of the Ar-Raqqah Museum as well as damage to the doors, shutters and windows.  To outline the damages we have included photos of the museum prior to and after this bomb strike.

This only adds insult to the already identified injury.  Previously DGAM reported that in Spring 2012 an armed group called Ahar al Sham had moved 527 artefacts under the pretext of protecting them. 

Then in June 2013 robbers seized an additional six containers that had been previously stored in the Raqqa Museum’s warehouse.  Through cooperation and negotiations with members of the local community three of these boxes were later identified in Tabaqa under the control of a group called “Cham free people”.  While the found boxes contained 104 artifacts ARCA hasn't been able to ascertain which pieces from the inventory were recovered.

The Museum of Raqqa was founded in 1981 and has been primarily dedicated to the preservation and exhibition of cultural heritage gathered from excavation research from the Ar-Raqqah province.  Its collection includes objects from Tell Bi’a, Tell Munbaqa, Tell Sabi Abyad, and Tell Chuera, and includes artefacts that date from Roman and Byzantine eras as well as objects from the Islamic period (the epoch of Haroun al-Rachid) and from the period of more recent Bedouin domination.

Situated in north-central Syria near to where the Balikh River joins the Euphrates the city of Raqqa once dominated the northwest corner of the heartland of the Islamic Empire precisely because it was a major stopover point for those traveling through the Syrian desert to other important cities in the region making it integral for commerce.  Because of this strategic location Raqqa has always been hotly contested throughout its lifespan, perhaps now more than ever.   L. Essay: Do you think art collectors might be tempted to buy Syrian antiquities (looted or otherwise?). We say resoundingly, yes.

On November 22, 2014 the Syrian Arabic Republic - Ministry of Culture's Directorate General of Antiquities and Museums (DGAM) published two striking photos of three confiscated artifacts removed from the Taibul Tomb in the Southeast Necropolis at Palmrya.  Taibul (TYBL in his native Palmyrene) was a rich Palmyran merchant who commissioned a tomb for himself and his family in 113 CE in a necropolis five kilometres southeast of Palmyra.

The tombs in this ancient graveyard are subterranean.  To the untrained eye, the zone where Taibul's tomb and others are located originally looked like just another tract of stony Syrian desert. But with the combined work of Syrian and Japanese archaeologists who documented the site between 2001 and 2005 we have learned much about Palmyrene funerary practices, couches, sepulchres and loculi.   

Unfortunately, the finely-sculpted figures of
men and women where of interest not only to archaeologists and historians documenting the site but more recently also to tomb raiders. But were these thieves savvy enough to understand what will sell on the antiquities art market or were they simply opportunists, taking advantage of what they could easily access?  

Are funerary busts of interest to collectors?

And are they willing to pay large sums for them?

A quick search on the internet would lead one to believe so.  In a few clicks I found one relief listed on eBay through Aphrodite Ancient Art LLC with little identifying where the object originated from.  The auction page states only that it was part of an “Early American private collection, 1960’s”.  eBay lists this one for a steal.  Its auction price is an eye-popping $13,500.

In 2011 an uglier Syrian limestone relief also went on auction.  Listed as Lot 69 in Sotheby’s June 8, 2011 auction, the object's provenance was listed as Sarkis and Haddad, Beirut, early 1970s.  Despite its humbler appearance, it still managed to find a buyer and fetched a modest sum of $8,125.

Going back to the Aphrodite website, I found a second, Syrian funerary relief of two brothers.  This one listed the object as coming from Palmyra with a provenance of having been purchased from Sotheby's New York in June 2011.  Buy it while it still lasts and collectors can get two funerary figures for a whopping $22,500.

Given the fragility of the Palmyra tombs and the many heritage sites damaged, at risk, or already looted as a result of the Syrian conflict, I wonder if it would be wiser if the experts shifted their focus away from statistical analysis to something more concrete.  Instead of trying to quantifying how much money ISIS/ISIL may, or may not, be making off of blood antiquities perhaps we should be stressing that more attention and funding is needed to trace who the individual traffickers are, both upstream and down.  If we do, Syria's cultural heritage might have a less grim outcome.   As for journalists in search of catchy headlines; vandalized tombs make just as dramatic a statement as vague value estimates and they can be substantiated with actual witnesses and imagery confirmation.

Given the gargantuan task of protecting antiquities in the midst of a civil war,  I think its pretty remarkable that DGAM had photo images matched so quickly to identify these pieces and to inform the public of their findings.  And while I am not prepared to go out on a brittle limb and assume any of these reliefs on sale or recently sold have dirty provenance, I do think their presence in the fine arts marketplace makes a pretty strong case that Syrian heritage objects are of interest to collectors.  The fact that they garner hefty sums further underscores that we have only seen the tip of the Syrian antiquities iceberg. 

Petty subsistence looters may fence objects for paltry amounts, middlemen fighters may take their cut, and end traffickers may make a bundle selling to auction houses and galleries, but all this useless faffing about of trying to put an unquantifiable dollar sign on how much its making which opponent in this war is doing nothing to stop the flow whatsoever.

In the end percentages are less relevant than simply understanding that collection-worthy pieces like these seen at auction or those stripped from Palmrya will surely find their way into the world's antiquities art market.  Maybe not immediately, but with the lack of market transparency and self policing, surely in the future.

Traffickers are patient.  So are collectors.
