The Journal of Art Crime, Fall 2011: David Gill's Column "Context Matters" looks at "Compliance and the Antiquities Market

In the Fall issue of The Journal of Art Crime, David Gill, in his column "Context Matters" looks at "Compliance and the Antiquities Market." Here's an excerpt from his column:

Over the years there has been a major change in the way countries have sought to reclaim archaeological material that had been looted. Claims have been made against the background of the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. This was accepted by the USA in 1984 and by the United Kingdom in 2002. 
Attempts to reclaim material were extended and tended to take time to go through the legal channels. Such disputes included the Kanakaria Mosaics to Cyprus, the Dekadrachm Hoard and the Lydian Treasure to Turkey, and the Aidonia Treasure to Greece. The case of the Sevso Treasure is unresolved as although it was certainly removed from its archaeological context by unscientific means, it has not been possible to confirm where this hoard was found. 
The seizure of the Medici Dossier in the Geneva Freeport (and related photographic archives in Basel and in Greece) has allowed the Italian authorities to adopt a different strategy. Images of objects in a fragmented state or still covered in mud have been an emotive force in the rhetoric surrounding the returns. Museums that were reluctant to negotiate were persuaded that bad publicity could be avoided if discussions about returns were initiated. In one case a major North American museum was shown images in 2005 and less than a year later had arranged to return 13 antiquities to Italy. It was, and is, hard to argue that something was in “an old collection” when the object had been recorded in a distressed state subsequent to the 1970 UNESCO Convention. 
Yet compliance has been reluctant in some quarters. Boston’s Museum of Fine Arts was aware nearly twenty years ago that the torso of a Weary Herakles fit the abdomen and legs of a statue that had been excavated at Perge in southern Turkey. The presentation of a collection history that suggested that the torso had surfaced in Germany in the 1950s was a distraction. The situation was made more complicated as the donors had retained part ownership of the torso. Full title was eventually transferred to the MFA.
David Gill is Head of the Division of Humanities and Professor of Archaeological Heritage at University Campus Suffolk, UK. He is a former Rome Scholar at the British School at Rome. He returned to Newcastle University as a Sir James Knott Fellow where he laid the foundations for Artful Crafts: Ancient Greek Silverware and Pottery (Oxford: Clarendon Press, 1994) written with Michael Vickers. He was appointed Museum Assistant in Research in the Department of Antiquities at the Fitzwilliam Museum, Cambridge where he had curatorial responsibility for the Greek and Roman collections. He then moved to Swansea University where he was Reader in Mediterranean Archaeology. His Sifting the Soil of Greece: the Early Years of the British School at Athens (1886-1919) (London: Institute of Classical Studies, 2011) was published to coincide with the 125th anniversary of the School.

Sotheby's sells Symes marble matched by Dr. Christos Tsirogiannis in the Schinousa archives for more than $4.6 million today; Sotheby's withdraws The Medici Pan; and Christie's in NY aims to sell Symes Pan tomorrow

Today Sotheby's auction house in New York sold an ancient marble head for more than $4.6 million even after Dr. Christos Tsirogiannis pointed out that the piece, owned by Robin Symes, matched an image in the Schinousa archives. 

On December 5, Professor David Gills wrote on his blog "Looting Matters" under the post Symes and Hermes-Thoth about a 2,000 year old marble head for sale at a New York auction house today:
I am grateful to my Cambridge colleague Dr Christos Tsirogiannis for pointing out that the head of Hermes-Thoth due to be auctioned at Sotheby's New York next week had once passed through the hands of Robin Symes (December 12, 2013, lot 39). The estimate is $2.5-3.5 million.... Colour images of the head feature in the Schinousa archive where they were identified by Tsirogiannis.


In 2006, Peter Watson and Cecilia Todeschini published The Medici Conspiracy: the illicit journey of looted antiquities, from Italy's tomb raiders to the world's greatest museums, an expose about the network of tombaroli and art dealers who funneled looted antiquities into private and public collections from the 1960s through the 1990s. Peter Watson wrote Mr. Symes legal problems in "The fall of Robin Symes" in 2005. On Trafficking Culture, archaeologist Neil Brodie summarizes the illegal activities of Giacomo Medici, convicted in 2005 of receiving stolen goods, illegal export of goods, and conspiracy to traffic. Here's how Symes is believed to have been involved:
By the late 1980s, Medici had developed commercial relations with other major antiquities dealers including Robin Symes, Frieda Tchacos, Nikolas Koutoulakis, Robert Hecht, and the brothers Ali and Hischam Aboutaam (Watson and Todeschini 2007: 73-4). He was the ultimate source of artefacts that would subsequently be sold through dealers or auction houses to private collectors, including Lawrence and Barbara Fleischman, Maurice Tempelsman, Shelby White and Leon Levy, the Hunt brothers, George Ortiz, and José Luis Várez Fisa (Watson and Todeschini 2007: 112-34; Isman 2010), and to museums including the J. Paul Getty, the Metropolitan Museum of Art, the Cleveland Museum of Art, and the Boston Museum of Fine Arts.

Neil Brodie explained in September 2012:
Investigative reporter Nikolas Zirganos took a special interest in the activities of British antiquities dealer Robin Symes, and was present in April 2006 when Greek police raided a villa on the island of Schinoussa belonging to Symes and his deceased partner Christos Michaelides. Zirganos described how the villa on Schinoussa was used for what he described as the ‘preparation and closing of deals’ (Zirganos 2007: 318). The villa was in effect a social and commercial hub, where Symes and Michaelides would entertain archaeologists, museum curators, conservators and wealthy collectors to gossip about the market and what was available for purchase, and to arrange sales. Thus, it was possible for a customer to purchase an illicit artefact on Schinoussa without actually coming into contact with it. The artefact would be smuggled separately to Switzerland, where the customer could take possession of it.
Jason Felch, author of Chasing Aphrodite and an investigative journalist for The Los Angeles Times, wrote of Symes in January 2013:
Last year, the Getty quietly returned 150 marble fragments in the collection (88.AA.140 - 88.AA.144) to Italy after evidence emerged that they joined objects found in the same looted tombs of Ascoli Satriano that produced the Getty's Griffins and statue of Apollo, which were returned to Italy in 2007. The objects and fragments were acquired in the 1980s from London dealer Robin Symes.
Dr. Gill described the Schinousa archive last June on "Looting Matters":
This photographic archive records the material that passed through the hands of a London-based dealer. If material from this archive resurfaces on the market, it would be reasonable to see the full collecting history indicated. But such information would no doubt be provided by rigorous due diligence searches.

Professor Gill also noted in "Looting Matters" that Dr. Christos Tsirogiannis identified "The Medici Pan" that was later withdrawn from the sale:
Sotheby's New York are due to auction a giallo antico marble bust of Pan next week (December 12, 2013, lot 51). The estimate is $10,000-$15,000. Dr Christos Tsirogiannis has pointed out to me that a polaroid image of the sculpture was found on the Geneva Freeport premises of Giacomo Medici.

Again, on the blog "Looting Matters", Dr. Gill writes about another item for sale that caught the eye of forensic archaeologist Christos Tsirogiannis:
Tsirogiannis has now identified a terracotta Pan from the Schinousa archive that is due to be auctioned at Christie's Rockefeller Plaza (December 13, 2013, lot 114, estimate $8000 - $12000). Christie's have offered the following collecting history:

So when was the Pan in the possession of Robin Symes? What is the identity of the private collection? Is the collecting history presented by Christie's robust? What authenticated documentation was supplied to Christie's?
The Edward H. Merrin Gallery has been linked to the bronze Zeus returned to Italy, material in the collection of Dr Elie Borowski, as well as the marble Castor and Pollux on loan to New York's Metropolitan Museum of Art.

Auction Alert and Antiquities Seizure: Second seizure at Royal-Athena Galleries, New York


On February 17, 2017 forensic archaeologist Christos Tsirogiannis alerted Assistant District Attorney Matthew Bogdanos in Manhattan that he had identified another antiquity, likely of illicit origin, apparently being laundered via the US art market.  The object in question had been listed for sale via Royal-Athena Galleries, a New York City-based gallery which is operated by Jerome Eisenberg.   Royal-Athena Galleries is the same New York gallery which relinquished an illicitly trafficked sarcophagus fragment to the country of Greece a few weeks ago.

The Becchina Archive is an accumulation of records seized by Swiss and Italian authorities in 2002 during raids conducted on Becchina’s gallery, Palladion Antique Kunst, as well as two storage facilities inside the Basel Freeport, and another elsewhere in Switzerland.  This archive consists of some 140 binders which contain more than 13,000 documents related to the antiquities dealer's business.  

Becchina's records include shipping manifests, dealer notes, invoices, pricing documents, and thousands of photographic images.  Many of the images are not slick art gallery salesroom photos, but rather, crude point and shoot polaroids taken by looters and middlemen depicting recently looted antiquities. Some of these polaroids show objects immediately after their looting and show objects which often still bear soil and salt encrustations. 

In 2011 Becchina was convicted in Italy for his role in the illegal antiquities trade. While he later appealed this conviction, antiquities like this vase, traced to this network of antiquities traffickers, continue to surface years after their original looting.  Objects like this one, have resurfaced in private collections, museums and some of the world's most well know and ostentatious galleries and auction houses specializing in ancient art so it is important for collectors to remain on alert to the history of the objects they consider for purchase. 

When discussing his identifications with ARCA Tsirogiannis indicated that the photograph below, of a handwritten note by Gianfranco Becchina himself, documents that the Italian dealer had knowledge of the looted Neck Amphora's existence at least as far back as 28 February 1994.  Documents in the archive which represent the dealer's own meticulous record-keeping, shows that Becchina acquired the vase on the 15th of March 1994 and paid for the object on the 11th of April of that same year.


It is important to note that this red-figure attic vase is one of the most important styles of figural Greek vase painting.  In the Italian dealer's records, the object appears in photographs together with another object, an amphora.  This second object has been redacted from the image presented for the purposes of this blog post as the object is still in circulation.  Both antiquities seem to have come from a single Italian looter or middleman trafficker identified only as 'Robertino'. Given this information, it is plausible that the second identified piece of Attic pottery was looted at or near the same period of time, and may likely come from the same Etruscan tomb. 

It is Dr. Tsirogiannis' opinion that the two object photo ties the vase definitively to the country of Italy and that therefore, the vase should be repatriated to the Italian authorities.  

Other examples of illicit material which have passed through this New York dealer's art and antiquities firm include:



Eight antiquities stolen from museums and archaeological sites worth US$ 510,000.

And most recently, on February 10, 2017, a sarcophagus fragment depicting a battle between Greeks and Trojans looted from Greece and relinquished to the Greek Authorities.

Speaking with Dr. Tsirogiannis about this most recent identification he stated "As in the recent case of the sarcophagus fragment that has been repatriated to Greece, so in this case the identification and the evidence are sending back to Italy a valuable Greek vase. This result was achieved with the cooperation of assistant district attorney Matthew Bogdanos in New York who handled the seizure and the archaeologist of the Villa Giulia museum in Rome Mr. Maurizio Pellegrini who provided crucial information about the identity of the looter involved."

Given the fact that it often takes sound identifications, such as those conducted by researchers actively working on the Becchina dossier, forfeiture by art market dealers should not be misconstrued as spontaneous acts of good well. In many of such cases, the antiquities are relinquished either to avoid lengthy litigation or as a gesture by the suspect holder of the object to remove themselves from any negative publicity caused by having their name associated with having handled or purchased trafficked art.

Yesterday ARCA reported on the assets seizures involving 78-year-old Gianfranco Becchina, an action taken in relation to probable collusion with the Sicilian mafia, Cosa Nostra. The disgraced Italian antiquities dealer was convicted in the first degree in 2011 for his role in the illegal antiquities trade. A portion of his accumulated business records, up until 2002, were seized earlier by Swiss and Italian authorities during raids conducted on Becchina’s Swiss art gallery, Palladion Antique Kunst, as well as two storage facilities inside the Basel Freeport, and another elsewhere in Switzerland. This archive of documents and photos, known as the Becchina archive, consists of some 140 binders containing more than 13,000 documents and photos related to antiquities, bought and sold, which at one point or another are known to have passed through this dealer's network of illicit suppliers.


Mafia association is a formal criminal offense provided for by the Italian penal code introduced into law via article 416-ter of Law no. 646/1982, and designed to combat the spread of the Mafia.

Art. 416-ter reads: 

"Any person participating in a Mafia-type unlawful association including three or more persons shall be liable to imprisonment for 7 to 12 years. 

Those persons promoting, directing or organizing the said association shall be liable, for this sole offence, to imprisonment for 9 to 14 years. 

Mafia-type unlawful association is said to exist when the participants take advantage of the intimidating power of the association and of the resulting conditions of submission and silence to commit criminal offences, to manage or at all events control, either directly or indirectly, economic activities, concessions, authorizations, public contracts and services, or to obtain unlawful profits or advantages for themselves or for others, or with a view to prevent or limit the freedom to vote, or to get votes for themselves or for others on the occasion of an election. 

Should the association be of the armed type, the punishment shall be imprisonment for 9 to 15 years pursuant to paragraph 1 and imprisonment for 12 to 24 years pursuant to paragraph 2. 

An association is said to be of the armed type when the participants have firearms or explosives at their disposal, even if hidden or deposited elsewhere, to achieve the objectives of the said association. 

If the economic activities of which the participants in the said association aim at achieving or maintaining the control are funded, totally or partially, by the price, the products or the proceeds of criminal offences, the punishments referred to in the above paragraphs shall be increased by one-third to one-half. 

The offender shall always be liable to confiscation of the things that were used or meant to be used to commit the offence and of the things that represent the price, the product or the proceeds of such offence or the use thereof. 

The provisions of this article shall also apply to the Camorra, ‘ndrangheta and to any other associations, whatever their local titles, even foreigners, seeking to achieve objectives that correspond to those of Mafia-type unlawful association by taking advantage of the intimidating power of the association." 

To further dismantle Matteo Messina Denaro’s operational funding, Italy's Anti-Mafia Investigative Directorate (DIA) moved to seize Becchina's cement trade business, Atlas Cements Ltd., his olive oil company, Olio Verde srl., Demetra srl., Becchina & Company srl., bank accounts, land, and real estate properties including Palazzo Pignatelli yesterday.  Palazzo Pignatelli is part of the ancient Castello Bellumvider, a separate portion of which is owned by the city of Castelvetrano and houses the town hall. 

During the execution of the seizure of assets at Palazzo Pignatelli, a fire mysteriously broke out in a first-floor study, located in Becchina's wing of of the property.  Called on the scene, fire department officials extinguished the flames yesterday and returned for a second time today, along with the DIA and scientific police to uncover any traces that would determine the cause of the fire.

The seizure of these Becchina assets comes following the cooperation of mafia associate/police informant Giuseppe Grigoli, known in wiretaps as Grig.  Grigoli once owned a chain of Despar supermarkets in northwestern Sicily, used to launder mafia proceeds into the legal economy.  Starting out in 1974 as the owner of one grocery, Grigoli parlayed his relationship with Cosa Nostra, building a business empire which was once valued as a 700 million euro enterprise. 

The Italian authorities seized Grigoli's assets when they tied him to mafia  transactions through banking documents from 1999 through 2002, when the "king of supermarkets" was at the height of his business success. The arrest and conviction of Grigoli proved to be the tip of the Trapani Cosa Nostra iceberg and served to flush out many players in the hidden network of strategic partners that facilitate the activities of fugitive Castelvetrano boss, Matteo Messina Denaro, including now, Gianfranco Becchina. 

As a now cooperating police informant, Grigoli told the PM of the District Anti-Mafia Directorate of Palermo that between 1999 and 2006 he was given envelopes filled with money by Becchina which were to be delivered to Vincenzo Panicola, the husband of Matteo Messina Denaro's sister Patrizia Messina Denaro.  But Becchina's mafia influence doesn't apparently stop at trafficking of antiquities and aiding and abetting a mobster on the run. 

An article written in today’s La Repubblica by journalist Salvo Palazzolo, reports that during a 2001 Carabinieri TPC wiretap into Becchina’s role in the illicit trafficking of antiquities, law enforcement authorities overheard conversations between Becchina and Santo Sacco, a former UIL trade unionist and city councillor for Castelvetrano, who was later sentenced for mafia association.

In police transcripts of those conversations Becchina implicated himself as being involved in vote fixing in support of the election campaign of Giuseppe Marinello, from the People of Freedom party, who, at the time, was running for a seat in the Chamber of Deputies representing Sciacca in Sicily.  In their conversation Sacco also boasted about his role in the campaign of Ludovico Corrao saying "But I fully carried inside an iron bell ... I'm not kidding, 6,400 votes..."  Both incidences clearly show the impact of organized crime on parliamentary elections in Sicily.

In a mysterious wrinkle to this story, ex senator Corrao was later the victim of a gruesome murder. In 2011 his throat was found cut with a kitchen knife, nearly decapitating his head, both wrists had been slashed and he was left in a bloody pool having apparently also been bludgeoned with a statuette. After the slaughter, Seiful Islam, a Bangladeshi servant, called the police and confessed to the murder.  Islam later attempted suicide while in custody and was found not guilty by reason of unsound mind and transferred to a psychiatric facility.

Organized crime is detrimental not just to art, but to the functioning of a society.

Restitution: An Attic Marble Anthemion from a Grave Stele returned to Greece


On June 9, 2017 forensic archaeologist Dr. Christos Tsirogiannis, wrote to ARCA and to the Art and Antiques Unit of London's Metropolitan Police (New Scotland Yard), INTERPOL and the Greek police Art Squad reporting that he had identified an Attic Marble Anthemion from a Grave Stele coming up for auction in Sotheby's June 12, 2017 London auction which he had traced to the archive of convicted Italian antiquities dealer Gianfranco Becchina. 

This accumulation of records was seized by Swiss and Italian authorities in 2002 during raids conducted on Becchina’s gallery, Palladion Antique Kunst, as well as two storage facilities inside the Basel Freeport, and another elsewhere in Switzerland.  The Becchina Archive consists of some 140 binders which contain more than 13,000 documents related to the antiquities dealer's business.  

These dealer records include shipping manifests, antiquarian dealer notes, invoices, pricing documents, and thousands of photographic images.  Many of which are not the slick art gallery salesroom photos, but rather, point and shoot Polaroids taken by looters and middlemen.  This latter type of image often depicts looted antiquities in their recently plundered state, some of which still bear soil and salt encrustations.

In 2011 Becchina was convicted in Italy for his role in the illegal antiquities trade and while he later appealed this conviction, he is currently under investigation by Italy's Anti-Mafia Investigative Directorate (DIA) who moved to seize his cement trade business, Atlas Cements Ltd., his olive oil company, Olio Verde srl., Demetra srl., Becchina & Company srl., bank accounts, land, and real estate properties including Palazzo Pignatelli in November 2017. 

Looted antiquities traced to Becchina's trafficking network, like this attic marble anthemion, continue to surface in private collections, museums and some of the world's most prestigious auction firms specializing in ancient art and are frequently identified by Tsirogiannis, archaeologists working with Italy's Avvocatura dello Stato, the Italian Carabinieri and the Greek police. 

In his email, Tsirogiannis stated that he had identified the attic marble anthemion in three professional and two Polaroids images as well as in four separate documents found in the confiscated Becchina business records. The dealer's documentation indicated that the stele appeared to have been in Becchina's hands from 1977 until 1990, when it was then sold on to George Ortiz, a collector and heir to the South American Patiñho tin fortune who lived in Geneva and whose name has appeared with regularity on this blog tied to purchases of objects of illicit origin.   Ortiz's name has long been associated with this trafficking network as his was one of the names found on the network organigram found in Pasquale Camera's personal possessions.

Interestingly both Becchina and Ortiz were never mentioned in the 'Provenance' section given by Sotheby's.   During the sale, the object's collection history was listed simply as follows: 


Possibly as a result of Tsirogiannis' identification, the 340 B.C.E. object (thankfully) failed to sell.  Eleven months later, in a May 7th 2018 issue of the Times, the newspaper reported that Sotheby's, not Tsirogiannis, had discovered that they had a false collecting history on the stele at which point "by way of a voluntary goodwill gesture" handed the stele over to the Metropolitan Police in London.  The Greek Embassy in London working with the Greek The Ministry of Culture authorities via the Directorate for the Documentation and Protection of Cultural Property, followed up with the legal claims necessary for restitution and on June 27th, 2018 Christos Tsirogiannis testified at the Greek consulate in London as to his findings. Subsequent to the above, the object was formally handed over on September 8, 2018.

After its return to Greece, yesterday, the column has been delivered to the Epigraphical Museum of Athens, Greece.

The reporting and commentary on the so-called "Medici Conspiracy" has exposed the way that major North American museums acquired recently-surfaced antiquities (Watson and Todeschini 2006; Silver 2009; Felch and Frammolino 2011). This was in spite of the 1970 UNESCO on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, the 1973 Declaration by the Archaeological Institute of America, the 1983 acceptance of the UNESCO convention by the US, and the varied acquisition policies of individual museums. Museums overlooked and ignored the ethical issues related to the damage of archaeological sites and, instead, emphasized the fact that they acquired objects in good faith and by legal means. Objects purchased through Switzerland, Paris, London, or New York were not considered to be problematic. The items had passed from their countries of origin to the international antiquities market. The release of the Medici Dossier photographs, seized in the Geneva Freeport, brought a sequence of major museums agreeing to hand over significant numbers of items: Boston's Museum of Fine Art, the Cleveland Museum of Arts, the J. Paul Getty Museum, the Minneapolis Institute of Art, New York's Metropolitan Museum of Art, the Princeton University Art Museum, and the Toledo Museum of Art (Gill and Chippindale 2006; 2007a; Gill 2009a; 2010). And it is clear that material in other major North American museums has been identified and that this shameful list will expand.

He has published widely on archaeological ethics with Christopher Chippindale. He wrote a history of British archaeological work in Greece prior to the First World War in Sifting the Soil of Greece: The Early Years of the British School at Athens (1886 - 1919) (Bulletin of the Institute of Classics Studies, Supplement 111; London: Institute of Classical Studies, 2011), xiv + 474 pp.

Are all the apples in the North American museum barrel rotten (Gill and Chippendale 2007b)? There is one clear exception that suggests that there is at lest one sensible voice of concern and reform. In January 2012, Maxwell Anderson, the newly appointed Director of the Dallas Museum of Art (DMA), became concerned about the museum's holding of material derived from Almagià. He clearly wanted to pre-empt any external investigation that could reveal embarrassing and potentially damaging information about the museum. Anderson decided to post details of the objects, along with their stated collecting histories, on the Association of Art Museum's Director's (AAMD) object register website. This website, hosted by Anderson's former institution, the Indianapolis Museum of Art, had been intended to be used for displaying information about new acquisitions, rather than reviewing the cases of older ones. Such a move indicated a major change in attitude toward the issue of toxic antiquities that were potentially lurking in the collections of North American museums.

Auction Alert and Antiquities Seizure: Royal-Athena Galleries, New York

On January 8, 2017 forensic archaeologist Christos Tsirogiannis alerted Assistant District Attorney Matthew Bogdanos in Manhattan and ARCA that he had identified another illicit antiquity, apparently being laundered via the US art market.  The object in question had been listed for sale via Royal-Athena Galleries, a New York City-based gallery which is operated by Jerome Eisenberg

According to Tsirogiannis the object identified was a 64.8 x 90.8 cm. sarcophagus fragment which matches four polaroid images and three handwritten notes found in the Becchina archive. 

This accumulation of records was seized by Swiss and Italian authorities in 2002 during raids conducted on Gianfranco Becchina’s gallery, Palladion Antique Kunst, as well as two storage facilities inside the Basel Freeport, and another elsewhere in Switzerland.  The Becchina Archive consists of some 140 binders which contain more than 13,000 documents related to the antiquities dealer's business.  

These records include shipping manifests, dealer notes, invoices, pricing documents, and thousands of photographic images.  Many of the images are not slick art gallery salesroom photos, but rather, are point and shoot polaroids taken by looters and middlemen which depict recently looted antiquities, some of which still bear soil and salt encrustations. 

In 2011 Becchina was convicted in Italy for his role in the illegal antiquities trade and while he later appealed this conviction, looted antiquities traced to his trafficking network, like this sarcophagus fragment, continue to surface in private collections, museums and some of the world's most well know auction firms specializing in ancient art.  

In releasing his identifications to ARCA Tsirogiannis said:

"Regarding the sarcophagus fragment, each of the four Polaroid images depicting the fragment is included in a different file of the Becchina archive:

I discovered the first image (attachment no. 1) in a file that Becchina created to archive the antiquities he was receiving from a Greek trafficker termed in the archive ‘ZE’ or ‘ZENE’ (the beginning of his surname) or ‘Giorgio’ (Giorgos, his first name in Greek). This trafficker, now deceased, was well-known to the Greek police art squad.

In a separate handwritten note (attachment no. 2), Becchina records that he received the antiquity (‘1 Frto. [meaning ‘Fragment’] di sarcofago’) for 60.000 Swiss Francs on 25 May 1988.

This antiquity is recorded as the 9th object included in the 34th group of antiquities that ‘Zene’ sent to Becchina (see attachment no. 3).

Another note (attachment no. 4), a handwritten page, lists a group of antiquities that Becchina bought from ‘Zene’, from November 1986 until October 1988, for more than $250,000, including the sarcophagus’ fragment (no. 9).

The fifth attachment is a photocopy of a Polaroid image, depicting the same antiquity; this image was attached to a blank A4 page, together with other Polaroid images depicting other antiquities that ‘Zene’ smuggled from Greece to Becchina, under the title ‘in PF’, meaning that all these antiquities were stored at the time at the P[ort] [F]ranc (the Free Port) of Basel.

Finally, I am sending you another handwritten note (attachment no. 7), in which Becchina is asking one of the restorers he was using, Andre Lorenceau, to clean (‘reinigen’) the fragment and to add a base (‘sockeln’), as a support (by drilling into the antiquity). I discovered this note in the Becchina file dedicated to his cooperation with the restorer Andre Lorenceau."

According to the Royal-Athena Galleries website, the sarcophagus fragment has been attributed by Dr. Guntram Koch, an academic with an expertise in Roman sarcophagoi.

In addition to notifying the New York authorities, Tsirogiannis informed INTERPOL and the Greek police art squad. 

The object in question was seized by US authorities at approximately January 14 2:00 pm EST.

Nearly ten years ago in November 2007 Eisenberg returned eight antiquities stolen from museums and archaeological sites worth US$ 510,000 to Italy. Given the fact that it often takes sound identifications, such as those conducted by researchers such as Tsirogiannis, restitutions by art market dealers should not be misconstrued as spontaneous. In most cases pieces are relinquished merely to avoid lengthy litigation or in order for suspect dealers to remove themselves from the negative publicity caused by being subject to criminal charges.

While the West Seeks Tighter Curbs on the Trade in Antiquities Looted by ISIS, Italian Suspect Antiquities Continue to Appear at Major Auction Houses

Greek forensic archaeologist Christos Tsirogiannis, has identified another grouping of suspect antiquities set for auction October 1, 2015 at Christie’s in London.  Each of the objects appears to have ties to former Basel-based art dealer, Gianfranco Becchina, who was accused by Italian prosecutors of being part of an antiquities trafficking network that involved tombaroli (tomb raiders) in southern Italy and suspect antiquities dealers and buyers around the globe. Becchina was convicted of antiquities trafficking in 2011.

Since 2007, Dr. Tsirogiannis has actively identified illicit antiquities depicted in the confiscated Medici, Becchina and Symes-Michaelides archives, notifying the relevant government authorities when matches are discovered.  An expert on the illicit antiquities trade, Dr. Tsirogiannis teaches ARCA's illicit antiquities course.  He also serves as Research Assistant to the Trafficking Culture Project at the Scottish Centre for Crime and Justice Research located at the University of Glasgow.

Despite having apparently “clean” collection histories, each of the antiquities listed below (Lots 6, 8 and 16) — or strikingly similar ones — appear in photographic evidence confiscated by the Swiss and Italian authorities in 2002 during their investigation into the network of traffickers affiliated with Gianfranco Becchina.


The three antiquities on offer at the upcoming sale at Christie’s are said to come from Professor Heissmeyer’s antiquities collection; A fourth antiquity (lot 93) was temporarily confiscated by the Swiss authorities in 2008 from the Japanese illicit antiquities dealer Noriyoshi Horiuchi and has now been put back into circulation within the antiquities market. 

Dr. Christos Tsirogiannis has notified Interpol, the Carabinieri Art Squad and Scotland Yard’s Art & Antiques Unit with the evidence for these new identifications.

The same oenochoe seems to be depicted in a Polaroid image from the Becchina archive. In the archival photo the vase is covered with encrustations, lying on what appears to be a plastic tray, while a handwritten note, also in the archives, states that this antiquity was sent for restoration, among other antiquities, on 1 December 1989 to Sandro Cimicchi, Gianfranco Becchina’s usual restorer.

In the Becchina archive, what appears to be the same cup is depicted in a Polaroid image, upside down and partially covered with encrustations, among three other cups. The similarities can be identified from the position of the panthers painted on the lower portion of the cup's body. A handwritten note states that the cups were bought by the middleman Raffaele Monticelli on 4 March 1993. Another handwritten note on the Polaroid states: ‘V/ Hae CH’ [sold to Hae Swiss Francs]. In 2002 Monticelli was sentenced to 4 years imprisonment for conspiracy related to the trafficking of antiquities. (Isman 2011b: 50; Watson and Todeschini 2007: 292) and as recently as today had 22 million euros worth of his real estate assets confiscated by the state for his alleged involvement as an international antiquities trafficker.

The lekythos’ collecting history (‘Provenance’), as it appears in the Christie’s catalogue, is:
Anonymous sale; Münzen und Medaillen AG, Basel, 14 November 1986, lot 213.
Formerly private collection, Japan, acquired privately in 1997.


This lekythos was found and confiscated during the raid of the Swiss and Italian authorities at the warehouse of the Japanese dealer Noriyoshi Horiuchi in the Geneva Freeport in 2008. The Italian authorities could not prove the illicit origin of this particular lekythos and
although Horiuchi did not supply any documentation to prove the licit origin of the lekythos, the vase was returned to Horiuchi. 

In total the Italian authorities confiscated 337 antiquities from Horiuchi depicted in the Becchina, Medici and Symes-Michaelides confiscated archives. Horiuchi's name also comes up in a 2014 repatriation case involving another Becchina linked antiquity, a 1,800-year-old sarcophagus lid depicting a sleeping Ariadne.  

It should also be noted that this same lekythos also appeared at one time on offer at ‘Phoenix Ancient Art’ gallery, owned by the Aboutaam brothers, one of whom was convicted in Egypt for antiquities smuggling and the other of whom pleaded guilty to the falsification of at least one customs document. 

In relationship to that listing  the lekythos appeared as ‘SOLD’ on the ‘Phoenix Ancient Art’ gallery website. In the October sale listing Christie’s fails to state the name of the consigner, although they do so in the case of the other three lots (Professor Heissmeyer).

In the three first cases, Christie’s ‘due diligence’ seems to have stopped short of tracing the collecting history back one step further, which would have opened the window on the Becchina transactions.  In the fourth case (lot 93), Christie’s record lists the 1986 and 1997 transaction dates in the lekythos’ collecting history, but completely avoids mentioning the authorities’ raid of Horiuchi’s warehouse in Switzerland or the subsequent passage or ownership of the vase by the convicted Aboutaam brothers, through their ‘Phoenix Ancient Art’ gallery in New York and Geneva.

In total, these are just four objects in a string of tainted auctions with fairly good documentation proving their likelihood that these objects were looted.  If the art market cannot hold itself to task on objects where there is a known and extensive photographic record of illicit activity how will the art market perform its due diligence on antiquities coming from conflict countries like Syria, Iraq and Yemen where no confiscated smuggler dossiers exist?

Due diligence of looted antiquities, be they Italian or conflict-based, has to be meaningful and not merely plausible, in the furtherance of a sale's commission.  Partially-documented histories in an object's collection background, do not necessarily always point to fresh looting or illegal export but when the objects background looks murky, as is the case with these objects, the art market needs to step up its game and voluntarily refuse to participate in the laundering.

UPDATE - October 01, 2015 Christie's has withdrawn the suspect antiquities prior to the auction scheduled today in London.
